Diversità culturali e best interest of the child

The text describes the “normative social representations” (to be understood as the common mental maps that condition the internalization of the rules) of a sample of Moroccan parents and a sample of Italian juvenile judges in relation to the general clause that jurists call ” best interest of the child ”. The hypothesis of research that is advanced here is that the way of conceiving and using cognitively this clause by the two groups of researched subjects condition the way in which the Italian norms concerning the exercise, limitation and forfeiture of parental authority is applied. This will make it possible to highlight whether the representations that people employ at an implicit level may risk leading to the ineffectiveness of some provisions issued by the judicial authority.
